A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §61-5-30, relating to defining the crime of filing a fraudulent claim against a doctor; and setting criminal penalties.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §61-5-30, to read as follows:

ARTICLE 5. CRIMES AGAINST PUBLIC JUSTICE.

§61-5-30. Fraudulent claims against a physician.

If any person knowingly files a fraudulent claim or demand against a physician or surgeon, that person shall be guilty of a felony and, upon conviction thereof, shall be confined in in a state correctional facility not less than one nor more than five years or fined not more than $5,000 or both fined and imprisoned.

 

NOTE: The purpose of this bill is to define the crime of filing a fraudulent claim against a doctor.
